Villa Baan Waan rental terms and conditions

Villa rentals

Villa Baan Waan is rented on this website directly from its Owners. The villa is furnished and equipped as described in the detailed descriptions provided on this website. Prices are as represented in price lists on this website, unless a different price is negotiated between you (the Guest) and the Owners. Prices are subject to change without notice. However, once a booking has been confirmed and a deposit received, the parties shall be bound to the price agreed.

Rental fees include: daily rental of the villa and the included equipment, use of swimming pool, sheets, towels and bathroom supply, use of water, electricity, and gas and daily cleaning and laundry service.

Payments

A deposit as calculated on this website by the time of booking (normally 25% of the rental cost) is payable on booking, by either a credit card or bank wire, and confirmation will not be effected until the whole of the deposit has been received. The balance of rental payments must be made 10 days prior to the beginning of the rental period either by a credit card or by bank wire. Alternatively the balance may be paid in cash Thai Baht upon check-in, provided the Guest has notified his or her intention to pay by this method not later than 10 days prior to arrival. Non-payment of the balance within this period or a failure to commit in due time to pay the balance by cash will constitute a notice of cancellation and the property will be re-offered and cancellation conditions applied.

The charges will appear in credit card statements under the name “Wizotel Co. Ltd.”.

Cancellation & refunds

Cancellation of a booking at any time or no-show will result in forfeiture of deposit(s) and payments made. In case the booking is cancelled less than 10 days before check-in date or in case of no show, the Owners keep the right to charge the Guest’s credit card for the full amount of the villa rent. Refund of monies paid for villa rental and services will be made only in the case that the villa becomes unfit for habitation and no equivalent replacement villa can be obtained.

House substitution

If as a result of a serious breakdown or failure in the house, or repairs need to be undertaken, and the Owners decide that it is not possible to honour the booking, the Owners will do their utmost to find a replacement property acceptable to the Guest, or as a last resort will refund any monies paid on unused rental. The Guest acknowledges that in this event, the Owners’ liability for damages will be limited to the amount of unused rental calculated on a pro rata calculation of days unused.

Check in/out

Check in time is 3:00pm, unless agreed otherwise with the Owners in due time. If you arrive early, you are welcome to leave your luggage at the house and then vacate the property.

Check out time is 11:00am, unless agreed otherwise with the Owners in due time. Check in at the airport is normally slow. We recommend that you check in at least one hour before your flight.

In case your booking is adjacent to another booking that was received before yours, and the Owners accepted out-of-hours check in or out times for that booking, your booking will be confirmed on the condition that you accept a later check-in time or an earlier check-out time than the official times.

Damage to property

The Guest is fully responsible for any breakage, damage, missing items or additional cleaning if the villa is left abnormally dirty. The Guest hereby agrees to pay the villa Owners the cleaning or replacement costs for all damages to personal property or to the real estate, which may occur as a result of their occupancy, excluding normal wear and tear. The Guest agrees to take all reasonable steps to ensure that their family and other guests in their party adhere to the rules and regulations affecting the villa. Rearranging the furniture or removing any items from the villa is prohibited.

Non smoking

Smoking of cigarettes, cigars or pipes in the villa, the balconies or entrances is strictly forbidden and may result in the Guest been required to evacuate the villa with no compensation.

It is allowed to smoke outside the villa, including in the swimming pool and garden areas. However the Guest is kindly requested to collect any left out, including ashes and stubs.

Throwing burning or cindering stubs in a forest or floral area is extremely hazardous and absolutely forbidden. Guests who fail to comply will be prosecuted to the full extent of law.

Cleaning and order

The villa must be delivered and left clean and in order. Crockery and other equipment of the villa (chairs, blankets, etc.) must not be used or transported out of the villa. Candles and oil burners are not permitted inside the villa and must be used with great care on paved terraces. After delivery, repairs of breakdowns caused by the Guest (plugging of WC and basins, damages to equipment and furniture and to the property, stains on mattresses and bed covers, broken crockery) will be charged to the Guest.

Neighbourhood consideration

Villa Baan Waan is located in a tranquil residential area. We ask the Guests to respect the neighbours and avoid making noise that may disturb the serenity of the neighbourhood, such as excessive volume of the audio-visual systems, shouts at the swimming pool, etc. This request applies to all hours of the day, but especially to night time after 10pm.

Liability

The villa has inherent dangers such as the swimming pool, the jacuzzi, gas cooking facilities, dry stone walls, un-gated access to roads, steep staircases, unfenced drops, wildlife, burglary and other liabilities not fully described here. The Owners cannot accept any liability for loss, stolen, theft, damage or injury to the Guest or the Guest’s personal property, occurring whatsoever relating to this contract and/or the rental property, as the Guest must be responsible for taking all necessary safety precautions. Equally, no claims of any sort will be entertained in the event of incidents occurring whilst occupants or guests are under the influence of alcohol or any drugs, whether therapeutic or not.

Child/infant safety

The Owners do their best to minimise the danger to infants and toddlers occurring from the use of the swimming pool, the garden, balconies, beds, cribs and other potentially hazardous furniture and facilities. However there is no guarantee that all risks have been eliminated. Some equipment in the villa may not conform to any safety standards. The Guests use all furniture and facilities at their own risk.

We draw the Guest’s special attention to the spiral staircases leading from the living room to the swimming pool, which are extremely dangerous to unattended infants, toddlers and children. Also adults should use these stairs carefully. Alternative stairs lead to the swimming pool and garden inside the villa through the basement.

We emphasise that the swimming pool is private and unguarded. Use of the swimming pool by the Guests, their parties and their guests is on their own responsibility.

Complaints

The villa is checked regularly by its staff or the Owners to ensure that it meets the required standards and that it is accurately reflected in descriptions and promotional material. Whilst the Owners will do all that is reasonably possible to ensure that the property complies with descriptions or rectify any problems which arise as a result of changes to the property or chattels, it cannot accept responsibility for last minute changes or variations outside of their control, including droughts, storms, or blackouts.

It is also possible to encounter noise and/or disturbances caused by third parties outside of the property. Also, clients should be aware that the villa is located in a rural area, so animals, insects, lizards, snakes and other wildlife might be present in a greater degree than the Guest expects. Such disturbances and presences are beyond the control and liability of the Owners.

Complaints have to be directed within 24 hours of the complaint's occurrence to the Owners’ representative, who will verify the problem, and endeavour to resolve the problem(s) or find an alternative solution. The Guest is obliged to give the Owners the necessary time to resolve the problem.

Vacating the rental property without authorization from the Owners does not constitute sufficient cause for refund, as we cannot verify a cause of your complaint without your presence. Failure to give notice of a problem when it occurs during the rental period and/or failure to remain in contact with the Owners’ representative during the remedial process will void any claim during or after the rental period. Should Guests leave the property for whatever reason without notifying the Owners’ representative, their claims for compensation will be rendered null and void.

Furthermore, please note that any refund offered to the Guest shall not exceed the amount of the villa’s booking price.

Disputes and acceptance of terms and conditions

The Owners and the Guest expressly agree that all disputes arising out of this contract and not resolved shall be resolved by applying Thai law exclusively in the courts of Surat Thani, Thailand, to the exclusion of all other courts and jurisdiction. The Owners must receive notice of any dispute in writing.

By reading and acknowledging the terms and conditions, the Guests agrees to be bound by the provisions contained herein and to accept liability for damages caused by them or their parties to the property.


Terms and conditions for vehicle rentals

Rental agreement

Vehicle rentals arranged through the staff of Villa Baan Waan are subject to a Rental Agreement that will be signed between the renting company (the Renter) and the client (the Rentee) at the time of the vehicle pickup. For your convenience we quote here excerpts from the Agreement.

Insurance

All vehicles except of motorbikes are covered by comprehensive insurance of international standards arranged by and at the expense of the Renter. A deductible of Baht 5,000 shall apply to every accident or loss where recovery cannot be made from a third party. In the event of accident damage occurring, the Rentee agrees to immediately notify the Renter so that arrangements for claims processing and repair can be made. Where possible, The Renter will provide a replacement vehicle at no additional charge over the period (a similar make and model can not be guaranteed as a replacement).

Deposit

The Rentee agrees that the credit card provided at the time of the villa booking will be used for any charges due in respect to the vehicle rental. If a credit card is not provided the Rentee may be required to pay a deposit on the sum of Baht 5,000 in cash when picking up the vehicle, which will be returned after deducting monies due at rental termination.

Vehicle Registration

The Renter is responsible for ensuring that the vehicle is registered for road use under the laws of the Kingdom of Thailand.

Maintenance

The Renter agrees to fully maintain and service the vehicle in accordance with the manufacturers handbook for the duration of the lease at his expense, unfair wear and tear excepted. The Renter will arrange for servicing and mechanical repair to be carried out, and will provide a replacement vehicle at no additional charge over the period (a similar make and model can not be guaranteed as a replacement). The Rentee agrees to advise The Renter whenever scheduled services are due or other mechanical repairs are required. The Rentee also agrees to maintain the vehicle with regular checks of fluid levels including, but not limited to, engine oil, battery and radiator fluids.

Misuse

It is forbidden to drive a vehicle of any type out off roads designated for normal motorised traffic. The Rentee will be responsible for damages due to misuse of the vehicle, including but not limited to damage to tires and chassis and rescue expenses.

Gasoline

The vehicles are provided with a minimum amount of gasoline sufficient for about half hour of driving. The Rentee is supposed to fuel the vehicle at a nearby gas station on his or her own expense. No refunds apply for unused fuel or for fuel in excess of that initially provided.

Traffic law violations

Rentee will pay all fines and penalties for traffic law violations that occur during the rental (including parking violations), and an administrative charge to the Renter for responding to authorities concerning such violations. The Renter may give information about the vehicle rental to those authorities.

Cancellation

Cancellation of a vehicle reservation at any time will result in forfeiture of deposit(s) and payments made.


Security and privacy

This security and privacy policy constitutes a part of the Terms & Conditions of this Web Site, which governs your use of this Site.  The Terms and Conditions, including this Privacy Policy, may be amended at any time by posting the amended Terms and Conditions on this Site.  The Terms and Conditions were last amended on 07 June 2006.

Secure transactions

For your protection, we have taken a number of steps to maximise the security of financial transactions that are accepted on this Web Site. The booking procedure is accomplished using secure processing services. Your entry of personal and booking details, including credit card information is encrypted when transmitted in secure mode (SSL).

The identity of the computer hosting this Site is ensured by an Equifax Secure Global eBusiness CA-1 SSL certificate provided by GeoTrust. Details of the certificate can be viewed when double clicking the lock icon appearing at the bottom of the browser window when SSL mode is active. The certificate is issued on the name of Wizotel Co. Ltd., the company that designed, constructed, hosts and maintains this Web Site. For this reason you will notice that pages of this Site using SSL are redirected to www.wizotel.com.

Credit card transactions and storage

We use a paranoid approach to maximise the protection of your credit card details. Both the card number and the CVC (Card Verification Code) are stored in our system only in encrypted format, using a powerful private key (RSA based) encryption algorithm. Once entered, the card number (except of its last 4 digits) and the CVC are never shown on the screen, neither to you nor to our staff, and never quoted in mailing or emailing. Our system is programmed so that the only time the numbers are decrypted is when sending them in secure mode (SSL) to the credit card company for processing. Even at that time, the numbers are not exposed to human eyes on our side. Moreover, in order to activate credit card processing an operation by our staff identified by a password is required. The numbers cannot be decrypted without that password, which is known to selected staff but never stored in the system.

Credit card payments will be processed by the villa’s aligned provider Agape Conferences. The charges will appear in credit card statements under the name “Agape Conferences”.

Liability

There are constantly changing restrictions in the use of encryption software and schemes that are used in various countries. The use of appropriate software and encryption options are your responsibility, and we assume no risk or liability in ensuring your compliance to local law.

Regardless of the precautions taken by you or by us, "perfect security" does not exist on the Internet. We cannot ensure or warrant the security of any information you transmit to this site, and you transmit such information at your own risk.

Username and password

When you submit your first booking request you will be asked to select a username and a password, which will enable you to log on to your record at any time, view its status or make modifications to your personal and booking details.

The password you choose will remain a secret known only to you. We do not store passwords in our system. When you subsequently log on to your record your password will be authenticated against an encrypted version of it. We use a one-way encryption algorithm to encrypt passwords, i.e. there is no way to reconstruct the password from the encrypted version. If you forget the password or want to change it for any reason you can use the Password Reset feature that will be presented to you when you click the “forgot password” link. The Password Reset feature lets you entering a new password. To verify that the new password has been entered by you, access to your record will be disabled after the password is reset and will be enabled only after you follow a verification procedure that will be emailed to the address stored in your record.

Personal information

We respect the privacy of our clients, and do not collect information from you without your knowledge. We need the following information in order to process your requests: your name, e-mail address and phone number. If you wish to use a credit card for your reservation, we also require your credit card number, its CVC (Card Verification Code) and its expiry date. We use the information we collect to process your requests and to notify you of their status. We will not release your data to outside organisations. We may however use information collected for market analysis and we may provide aggregate statistics to reputable third party vendors. We will not include any information that will personally identify any individual to any third party.

You acknowledge and agree that we may, from time to time, access your account and other parts of the service as necessary to identify, investigate or resolve technical problems or to respond to service complaints.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

Information you fill in your booking requests, including text typed in the “message” section but excluding credit card information, is mailed to us over Internet E-Mail. Please use the message section to send us non-confidential notes. Do not include confidential personal or private information. For your protection, our responses will not include any confidential information. Please do not use Internet E-Mail to send us transaction instructions. Customers who choose to send Internet E-Mail messages to us that contain confidential, private or personal information do so entirely at their own risk.

Disclosure to third parties

We will not sell, trade or rent any information to any third party. Disclosure may only be made upon an order from a Judicial or Regulatory Authority.

Use of "Cookies"

Cookies are implemented in various parts of our Web Site. However the use of Cookies is discretionary by you, and declining Cookies will result only in loss of certain conveniences such as session continuity and re-authentication during current or future sessions. In case we use Cookies they do not carry any of your personal information (name, email address, credit card, etc.) nor identification/password-type data that allows access to such personal information on our server.

Spam and virus attacks have become the major problem of email communication. To avoid spam we do not publish our email address, but instead ask you to send messages to us through our website after authenticating yourself with your username and password. This feature ensures that even if your or your organisation’s spam filter blocks our messages you will still be able to view them by visiting our website.
